FCC To Commence 3G Spectrum Auction

On December 29th the Federal Communications Commission (FCC) formally notified the National Telecommunications and Information Administration (NTIA) of the U.S. Department of Commerce that the Commission intends to auction licenses for certain Advanced Wireless Services - also called "3G Cellular" - as early as June 2006.

In a letter to Assistant Secretary for Communications and Information Michael D. Gallagher, FCC Chairman Michael K. Powell stated that the Commission intends to commence an auction for Advanced Wireless Services licenses in the 1710-1755 MHz and 2110-2155 MHz bands as early as June 2006. The 1710-1755 MHz band is currently occupied by federal government users that would be relocated pursuant to the recently enacted Commercial Spectrum Enhancement Act. That Act requires the Commission to notify NTIA at least 18 months in advance of beginning an auction of spectrum transferred from federal government to commercial use. It also requires NTIA to provide the Commission the estimated costs and timelines for the relocation of Federal entities from the bands at least 6 months prior to the auction.

New Import Monitoring Program for Industry Canada

Industry Canada (IC) is the Regulatory Authority responsible for equipment conformity assessment and approval under the Canadian Radiocommunications and Telecommunications Regulations. Testing of either radio or terminal equipment to establish compliance with Canadian technical specifications is performed in private sector laboratories, which, in the case of terminal equipment, are required to be recognised by Industry Canada.

Industry Canada has implemented a market surveillance and import monitoring program to verify that the requirements for Certification or Registration of equipment sold in Canada are met. A National Compliance Centre has been established to co-ordinate the activities of Regional Inspectors and Customs Agents monitoring the importation and sale of all products subject to regulatory approval. Unapproved products will be removed from the market and those responsible fined. An ongoing program of randomly auditing and testing equipment that has received prior certification or registration is also conducted. Equipment found to be non-compliant will be de-listed.
